1. Introduction

These Terms of Service govern the use of the website operated by PUSHLIGHT (LucyD Photography) and any photography services offered by us. PUSHLIGHT is operated by Lucy Dawlish as a sole trader based in County Durham, England.

By accessing this website or booking a session, you agree to be bound by these terms. If you do not agree with them, please do not use this website. These terms apply to all visitors, clients, and users.

2. Use of the Website

You agree to use this website only for lawful purposes. You must not use the website in a way that causes damage, attempt to gain unauthorised access to systems, or copy website content without permission. We reserve the right to restrict or terminate access if these terms are violated.

3. The Portrait Session & Pricing

  • The Session Fee: The Session Fee is £200. This includes up to four hours of photography time, pre-session planning, unlimited outfit changes within the time, a private online gallery, and one complimentary one-hour top-up session redeemable within 12 months.

  • Image Purchases: Digital images are not included in the Session Fee and are purchased separately at £35 per image. You are under no obligation to purchase a minimum number of images. Hand-editing begins once payment for your chosen images has been received.

4. Bookings, Payments, and Cancellations

  • Confirmation: Full payment of the £200 Session Fee is required at the time of booking to secure your chosen date. Your booking is not confirmed until payment has been received.

  • Rescheduling: You may reschedule your session once without charge provided at least 48 hours' written notice is given. Requests made with less than 48 hours' notice may incur a re-booking fee.

  • Cancellation & Refund Policy: If you cancel your booking outside of your statutory cooling-off period, the £200 Session Fee is strictly non-refundable as it covers your date reservation and administrative planning costs. If the Photographer must cancel due to unforeseen circumstances and a new date cannot be found, you will receive a full 100% refund.

  • Statutory 14-Day Right to Cancel: If you book online, by phone, or social media, you have a legal 14-day cooling-off period. If your shoot is scheduled within those 14 days, you expressly request our services to begin immediately, and your right to cancel is fully lost once the photography session takes place.

5. Intellectual Property & Copyright

All content on this website is the intellectual property of Lucy Dawlish trading as PUSHLIGHT. This includes all photographs, text, graphics, and design. Content may not be copied, reproduced, or used commercially without written permission.

The copyright of all client session images remains permanently and exclusively with Lucy Dawlish. Upon purchasing your images, you receive a personal-use and professional self-promotion licence. Images may not be resold or used for third-party commercial advertising campaigns without a separate Commercial Licence.

6. Data and Privacy

We take your privacy seriously. We collect limited personal information (such as names and emails) to manage your bookings, send gallery links, and handle invoices through secure third-party platforms like Pixieset, Stripe, and Google Drive. 7. Photographic Integrity & Use of AI

All photographs are edited by hand in our signature style. PUSHLIGHT does not use generative AI to create, alter, or edit client photographs. Your image files are handled securely and will never be uploaded to generative AI image-editing systems or used to train AI models.

8. Limitation of Liability

PUSHLIGHT will take reasonable care in providing services and safeguarding image files. In the unlikely event of total equipment failure, illness, injury, or circumstances beyond reasonable control, liability shall be strictly limited to a refund of the total amount paid by the client. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence.

9. Changes to These Terms

We may update these Terms of Service from time to time to reflect business or legal updates. Continued use of the website or booking services after changes are published constitutes your acceptance of the revised terms.

10. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes relating to the use of this website or our services will be subject to the exclusive jurisdiction of the courts of England and Wales.
